Plaintiff Timothy Schroeder (“plaintiff’) commenced this action pursuant to 42 U.S.C. § 1983 alleging, inter alia, that defendants County of Nassau, Nassau County Sheriffs Department, City of Long Beach, City of Long Beach Police Department, Long Beach Police Officer Lee Nielsen (“Nielsen” or “Officer Nielsen”), Long Beach Police Sergeant John Wflielan (“Whelan” or “Sergeant Wflielan”), and John Does 1-20 violated his rights under the Fourth Amendment of the United *125States Constitution by subjecting him to excessive force.
