The record before us discloses that, on March 21, 1921, First State Bank of Bronte recovered a judgment in the county court of Coke county, Tex., against I. O. Little,- appellee, for $575.20, with 10 per cent, interest per annum, and on October 14, 1927, James Spiller, purporting to act as agent and attorney for the state bank, made the necessary affidavit and caused the issuance of a writ of garnishment directed to and served upon the Republic National Bank of Dallas, Tex., commanding it, as the law requires, to answer as to its indebtedness, etc., to I.
