WOODROUGH, Circuit Judge.

This case was submitted to and decided by the trial court in favor of the plaintiff upon the pleadings. The defendants, who are the appellants here, are residents of Missouri, and appellee is a resident of California. Appellee was formerly the wife of appellant, Lloyd Boyle Howard, and one child was born of the marriage. Appellee obtained a decree of divorce from appellant Howard on October 11, 1934, in the Superior Court of the County of Los An-geles, State of California, awarding her the custody of their minor child, then six years of age, and the sum of $40 per…
