This is an action for damages, instituted by ap-pellee in the United States Court for the Central District of the Indian Territory at South McAlester, against the Choctaw, Oklahoma & Gulf Railroad Company, for the sum of $10,000. The case was tried in that court, and resulted in judgment in favor of appellee in the sum of $2,000. An appeal was taken to the United States Court of Appeals in the Inidan Territory, where the case was pending at the time of the admission of the state into the Union; and it comes to this court under the provisions of the Enabling Act.
