The appellant was convicted in the Circuit Court of Dallas County of a felonious assault upon one Truman Hicks by shooting him with a pistol. His punishment was assessed by .the jury at imprisonment in the penitentiary for five years. The defense was an alibi. The facts will be stated as necessary in the course of the opinion. . _ •. I.
