Appeal from a judgment of the Supreme Court (Lawliss, J.), rendered June 4, 2008 in Clinton County, convicting defendant upon his plea of guilty of the crimes of assault in the first degree and criminal contempt in the second degree.

Defendant was charged by indictment with assault in the first degree, assault in the second degree and criminal possession of a weapon in the third degree.
