This suit was an action in assumpsit to recover $2,000 upon a fraternal benefit certificate issued by the appellant society to Ernest H. Gregory, and payable, in the event of his death, to Pearl Gregory, now Pearl Gregory Blair, the appellee. Upon the first trial, a verdict was rendered for the appellee, Blair, in the sum of $2,133.33, and on a motion for a new trial, the verdict was set aside. Upon the second trial, the jury found for the appellant society and a motion for new trial was made by appellee, Blair, and withdrawn, and a motion filed for judgment non obstante veredicto. This…
