This is a contest over the proceeds of a sale made by the sheriff in foreclosure of a mortgage and vendor’s lien. The plaintiffs in the executory proceeding-own 13 notes of $1,000' each, and the intervener’ owns five notes of $l,000i each, and. one note for $500. All of the notes are of the same series, and secured by the same mortgage and vendor’s lien. The plaintiffs, William P. Leonard and wife, bought the property at the sheriff’s sale for $7,325; which, after deducting the taxes and costs, was hardly enough to pay the bank’s six notes with interest and attorney’s fees, much less to pay…
