MURRAY, Chief Justice.

This suit was instituted by Oscar W. Lawson against American-Amicable Life Insurance Company, seeking to recover the sum of $25,000, allegedly due on an insurance contract upon the life of Richard James Lawson, his son. Stipulations and admissions were made by the parties; and both parties made motions for summary judgment. The trial court overruled defendant’s motion for summary judgment, granted plaintiff’s motion, and proceeded to grant judgment in plaintiff’s favor against defendant for the sum of $25,000, together with interest at the rate of 6 per cent per annum…
