Appellant was tried for murder in the first degree for the homicide of Claude Tate. From a conviction of manslaughter, there is this appeal. The motion for new trial contains seven assignments, which we will discuss in suitable topic headings. .

I. Sufficiency of the Evidence. Assignments 1, 2, 3 and 4 in the motion for new trial present this issue. The affray, which resulted in the homicide of Tate, occurred in a beer tavern.
