DENNIS, Circuit Judge:

Appellant Kenneth Ray Ransom has been sentenced to death by the State of Texas for the murder of Arnold Pequeño. His execution has been scheduled for October 28,1997. Ransom’s conviction and sentence were upheld by the Texas Criminal Court of Appeals. Ransom v. State, 789 S.W.2d 572 (Tex.Crim.App.1989). The United States Supreme Court denied certiorari. Ransom v. State, 497 U.S. 1010, 110 S.Ct. 3255, 111 L.Ed.2d 765 (1990). Following unsuccessful post conviction actions in Texas state court, Ransom petitioned the federal district court for a writ of habeas corpus. The…
