The defendant, John E. Vitale, Jr., appeals from the judgment of conviction, rendered after a jury trial, of forgery in the second degree in violation of General Statutes § 53a-139 (a) (l),1 and, following his *3conditional plea of nolo contendere,2 of being a persistent felony offender in violation of General Statutes § 53a-40 (a).
