Plaintiff Larry Berke, a deaf individual, filed suit against the Federal Bureau of Prisons (“BOP”) and Charles Samuels, Jr., in his official capacity as the Director of the BOP (“Defendants”), alleging that defendants discriminated against him in violation of the Rehabilitation Act, 29 U.S.C. § 790 et seq., by failing to adequately accommodate his deafness.
