The plaintiff in error, hereinafter called defendant, was charged in the district court of Tulsa county with the crime of robbery with firearms. He entered a plea of guilty, and his punishment was fixed at the death penalty. The prosecution is under the pro visions of section 1784, Comp. St. 1921, and chapter 44, Session Laws 1925, which latter act fixes the maximum punishment at death and the minimum at imprisonment in the penitentiary for five years.
