MEMORANDUM OPINION
DAVIDSON, District Judge.
Presently before the court is the motion of the defendant for the entry of summary judgment on its behalf. Finding that the motion is well taken, the court shall grant the same.
I. FACTUAL BACKGROUND 1
The plaintiff Tony Tillman was employed by the defendant City of West Point as a police officer from on or about May 5, 1987. The defendant West Point suspended him on or about May 16, 1995, and later terminated his employment on March 12, 1996.
