Melvin Sweeney pled guilty in April 1988 in the United States District Court for the District of Vermont to one count of conspiracy to possess and distribute marijuana in violation of 21 U.S.C. § 841(a)(1), and one count of making a false statement in violation of 18 U.S.C. § 1623(a). Because the crimes were committed in early 1988, Sweeney was sentenced under the Sentencing Guidelines. After defendant’s guilty pleas, the United States Probation Office conducted an investigation of defendant and prepared a presentence report.
