This action was brought in the circuit court of Shelby county to replevin one car load of paper bags shipped by the defendants in error to the Sledge-Wells Company, *483a concern formerly doing business in Memphis, this State. It appears from the record that on the 21st of January, 1905, the defendants in error sold to the Sledge-Wells Company a car load of paper bags. The goods were shipped during the latter part of February of the same year, and arrived in Memphis over the Southern Railroad in the early days of March.
