Appeal from a judgment of the County Court of Cortland County, rendered March 28, 1977, which resentenced defendant, as a second felony offender, to concurrent indeterminate terms of imprisonment of not less than 5 nor more than 10 years upon his convictions of the crimes of burglary in the second degree and robbery in the second degree. Defendant was originally convicted of the crimes of burglary in the first degree (Penal Law, § 140.30, subd 4) and robbery in the first degree (Penal Law, § 160.15, subd 4) and sentenced to concurrent indeterminate terms of imprisonment of not less than 5 nor…
