—After Samuel Colacurcio and Dawn Burger were involved in a car accident, Colacurcio filed suit against *491Burger. Colacurcio moved for and was granted an order of default, and default judgment was entered shortly thereafter. Colacurcio did not provide notice of the motion for default to Burger. Colacurcio had engaged in extensive settlement negotiations with Burger’s insurance company before and after the suit was filed and before and after the motion for default.
