NORTHCUTT, Justice.

This case being before us on motion for rehearing in which it has called to our attention that we erred in quoting a certain ordinance, we withdraw our former opinion and file the following therefor.

Appellees, C. Richard Wagner and others, brought this suit for declaratory judgment and injunction against appellants, Robert Ricks, the City of Amarillo and its building inspector, J. L. Adams.
