Judgment unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: In 1942 Stanley Tomaka imposed various restrictions on 931/2 acres of property he owned in the Town of Hamburg. One of the restrictions, which were filed in the Erie County Clerk’s Office, provided that only single-family homes were to be built on all but 2.9 acres of the property.
