Appeal from an order of the Supreme Court (Cobb, J.), entered September 13, 1996 in Columbia County, which, inter alia, granted plaintiffs’ motion for summary judgment and made a declaration in their favor.

Plaintiffs are the owners of seven lots in College Crest Estates, a residential development on approximately 33 acres in Columbia County. This subdivision, created in 1974, contains 41 lots, each of which is subject to a “declarations of covenants, conditions and restrictions”.
