This adversary proceeding is before the court on the parties’ cross-motions for summary judgment, regarding the plaintiffs assertion that certain severance payments made by the debtor to the defendant are avoidable as fraudulent transfers. The defendant’s motion also seeks summary judgment on the plaintiffs assertion that the payments are avoidable as preferential transfers.
