- The defendant, American Mutual Insurance Company (American Mutual), appeals from a judgment for damages, attorneys’ fees, and costs. Following a jury trial, a judge of the Superior Court found that American Mutual had committed unfair or deceptive acts or practices by refusing to settle the tort claim of the plaintiff Louis DiMarzo for the limits of its motor vehicle liability insurance policy.
