Elizabeth Brown, died testate on November 2, 1944, leaving her husband, Sherman Brown, appellant, as her sole heir at law, and leaving no child or descendant of any deceased child, and no father or mother.
The appellee, The Union Trust Company of Greens-burg, Indiana, was appointed and duly qualified as executor of the will which was regularly probated on November 9, 1944. On October 8, 1948 the executor filed its final report of settlement in the estate which was set for hearing on November 3, 1948.
