This is an appeal from an order refusing to change the place of trial from the city and county of San Francisco to Alameda County. The plaintiff commenced an action alleging the breach of a written contract of employment. He filed his complaint in the Superior Court of the State of California, in and for the City and County of San Francisco, caused a summons to be issued and served on the defendant, and the defendant appeared, filed a demurrer, affidavit of merits and of residence, memorandum of authorities, and a notice of a motion to change the place of trial.
