The defendant in error moved that this case be transferred to the Court of Appeals. The question of jurisdiction depends solely upon the following facts: An execution was levied upon property of the defendant in fi. fa., who filed an affidavit of illegality. The trial of the issue as thus made resulted in a verdict in favor of the plaintiff in fi. fa. The defendant’s motion for a new trial was overruled, and he excepted.
