Action of trespass for assault. Appeal from the City Court of East St. Louis; the Hon. W. J. N. Moyers, Judge, presiding. Heard in this court at the February term, 1904.

This was a suit in trespass by appellee against appellants, Fred Ziegenhein, Morris Sternberger and Eugene Ziegenhein, partners, doing business under the firm name of Ziegenhein Furniture Company. The declaration charged that the defendants ivith force and arms assaulted, beat and permanently injured plaintiff. A subsequent amendment charged that defendants made the assault by their agents and servants. The defendants filed a joint plea of the general issue and on the trial there was a verdict in favor of plaintiff for $500, for which amount judgment was entered.
