Petitioner appeals the denial of his petition for post-conviction relief, asserting that the post-conviction court erred in rejecting his claim that he had inadequate assistance of counsel at his criminal trial and on direct appeal of his conviction for aggravated murder. Petitioner also has filed an emergency motion to remand this case because he wishes to amend his petition for post-conviction relief to allege a claim, based on Atkins v. Virginia, 536 US 304, 122 S Ct 2242, 153 L Ed 2d 335 (2002), that he is ineligible to receive the death penalty on the ground that he is mentally retarded.…
