Plaintiff in error, James Williams, defendant below, was charged by information in the district court of Pushmataha county, Oklahoma, with having in said county committed the crime of assault with a dangerous weapon on or about December 4, 1948, upon the person of one Herman Crump. The defendant was tried by a jury, convicted, his punishment fixed at 2 years in the State Penitentiary, judgment and sentence entered accordingly, and from which this appeal by transcript has been perfected.
