Appellant applied on the 9th of March, 1901, to the civil district court for a mandamus directed to the board of police commissioners, commanding it to grant him a new trial, or to show cause why the trial and sentence dismissing him from the police should not be set aside, as having been conducted contrary to all the forms of law, and unjustified by the facts; that it be ordered to answer, and, after due proceedings had, there be judgment annulling and avoiding the trial and sentence passed on the 3d of October, 1900, dismissing him from the police force;…
