The relator was a captain on the police force^of the City of New Orleans. He was tried by the Board of Police Oommissioners, the respondent herein, on the charge of “conduct unbecoming,’’ and dismissed from the force. This was on the 18th day of October, 1899. On the 3rd of October, 1900, one year less fifteen days after his dismissal, he presented to the respondent Board an application for a new trial.
