— C. Earl Rogers, plaintiff, filed an original petition in mandamus in this court against Ana Frohmiller, as state auditor, defendant, requiring her to approve certain claims for salary presented by him.
The facts of the case are not in dispute, and may be stated as follows: Up to December 12, 1941, E. T. Houston was a duly qualified and acting member of the industrial commission of Arizona, for the term which expired on January 8, 1942.
