This is an action of debt instituted in the Circuit Court of Barbour County in July, 1946, by the plaintiff, State of West Virginia, at the relation of George P. Alderson, State Tax Commissioner of West Virginia, for the use and benefit of the County Court of Barbour County, West Virginia, to recover from the defendants, Boyd E. Holbert and The Fidelity and Casualty Company of New York, the principal sum of $175.00.
