ORDER In 2002, Plaintiff Michael Wearry was convicted of first-degree murder and sentenced to death for the 1998 killing of Eric Walber. After spending years on death row, in 2016, the United States Supreme Court vacated Mr. Wearry’s conviction, finding “the prosecution's failure to disclose material evidence violated Wearry's due process rights.” Wearry v.
