Memorandum and Order

Aquilino, Judge:

The plaintiff has moved for summary judgment in this action, which contests U.S. Customs Service denial of a request for reliquidation pursuant to 19 U.S.C. § 1520(c)(1). In response, the defendant (1) denies several allegations of material facts set forth in plaintiffs supporting statement pursuant to CIT Rule *37756(i) and (2) has moved to dismiss the action for failure to state a claim upon which relief can be granted.1
