An apartment building wall has collapsed and the building vacated. The defendant Erin Construction Corporation, charged with building code violations said to be related to the collapse, appears before the court for sentence on a plea of guilty to the violations. The New York City Corporation Counsel, the prosecutor, has moved to sentence the defendant under the provisions of Penal Law § 80.10 (2) (b) which authorizes a fine in the amount of twice the gain realized as a result of the unlawful conduct.
