HOOD, Judge.
On February 10, 1964, a warehouse owned by Johnson Chevrolet Company, Inc., was partially destroyed by fire, in Bunkie, Louisiana. Hardware Dealers Mutual Fire Insurance Company had issued a fire insurance policy covering the building, and this policy was in effect at the time of the fire. Pursuant to its obligation under that policy, the insurer paid to Johnson Chevrolet the sum of $5,000.00, and it became sub-rogated to the rights of the insured to recover its loss up to the amount of that payment.
