MEMORANDUM OPINION
BERNARD MARKOVITZ, Bankruptcy Judge.
Consumers Produce Co., Inc., plaintiff in this adversary action, has brought a mo tion for summary judgment with respect to its claim that a debt owed to it by debtor in the amount of $37,582.57 is excepted from discharge by § 523(a)(4) of the Bankruptcy Code. According to Consumers, there is no genuine issue of material fact concerning the proposition that, by not paying for produce it had supplied to him, debtor committed a defalcation while acting as a fiduciary.
