Defendant, Norman Bailey, was arrested and charged with driving while under the influence of alcohol on May 1, 1992, after he allegedly backed up and hit another car in a municipal parking lot in Edwards-ville. Defendant refused to submit to a breathalyzer test after he was given the “Warning to Motorists” and he was served with a notice of statutory summary suspension. On May 4, 1992, defendant filed a petition seeking a hearing to rescind the statutory summary suspension of his privilege to drive.
