Affirming.
The appellant, James Welch, was indicted for and convicted of the crime of murder in the Fayette circuit court and his punishment fixed at confinement in the penitentiary for and during his natural life, and the court having overruled his motion for a new trial, he prosecutes this appeal. The victim of the homicide was. J. S. Thomason, the instrument used by appellant was an automatic Savage pistol and the offense was committed on Main street in the city of Lexington at about four o’clock in the afternoon of December 24, 1919.
