The appellant was the defendant in a suit brought by appellee to recover damages to a shipment of cattle. Prom a judgment rendered in favor of plaintiff for $1,398.10, the defendant has appealed. The plaintiff alleged that at 7 p. m. on November 26, 1920, defendant accepted from plaintiff, at Bovina, Tex., 341 head of cattle for transportation to Rankin, Tex; that said cattle reached destination at 9 a. m. November 29, 1920, and were retained on the cars during the trip without feed and water, although plaintiff made repeated requests that the cattle be unloaded for feed and water; that the…
