THE COURT.

This cause was taken over by this court after decision in the District Court of Appeal, First- Appellate District, Division One, solely because the appeal, so far as research has disclosed, presents for the first time a conviction under section 71 of the Penal Code, which section declares it to be a penal offense, punishable by fine or imprisonment- in the state penitentiary, for a public officer to be “interested” in public contracts in a manner prohibited by law.
