The plaintiff sues the defendant for damages for an assault committed on him by the defendant’s agent at Salisbury where he was to change cars from the Glasgow branch of defendant’s railroad to its main line.

The plaintiff, was a young man of slight bnild. Burkhardt, the agent, alleged to have committed the assault was a large, heavy man. On the morning of the day of the occurrence plaintiff took passage from Glasgow by way of Salisbury to Macon, Missouri.
