This is an action for declaratory relief and damages in which Plaintiff Cal Lombardi, individually and d/b/a Cal’s Jackpot Casino (“Lombardi”) alleges that he was the insured under a commercial general liability policy issued by Defendant Maryland Casualty Company (“Maryland Casualty”). On December 27, 1993, Maryland Casualty informed Lombardi that the company would not indemnify him for punitive damages, if awarded, in pending litigation.
