This action was brought by Edward Martin, the father and guardian ad litem of Helen *291Martin, a minor sixteen years of age, to recover damages for an alleged indecent assault upon her by the defendant. The complaint contained two causes of action. The court upon the trial sustained a challenge to the evidence pertaining to the second cause of action, and that cause was eliminated. The complaint alleged, in substance, that the defendant was conducting a retail candy and soft drink store, in the city of Seattle; that Helen Martin was employed by defendant as a clerk in said store, and began work…
