On June 15, 1932, the record in this case was mailed by appellant's counsel to the clerk of this court and same was received’by the clerk on June 16, 1932, as shown by his notation thereon. However, the clerk declined to file the record for the reason that judgment overruling the motion for new trial appearing in the transcript was dated April 15, 1932, and it, therefore, appeared that the record had reached our court sixty-two days after the motion for new trial was overruled.
