In tbis action, the receiver of the .Broadway Motórs Company seeks to recover the value of certain automobiles wbicb be alleges to be the property of the motors company named, and wbicb be alleges the respondent MacCallum-Donahoe Company took and converted to its own use. After issue bad been joined on the allegations of the complaint, a trial was bad before the court sitting without a jury, resulting in a denial of the right of the receiver to recover. the receiver appeals.
