This action was commenced by appellants against respondent and others to recover damages for personal injuries to Lucie S. Olin, caused by a fire which occurred in a room in a building owned by him. The room was leased by respondent and his wife to E.L. Drake, and a balcony therein was sublet by Drake to A.E. Varnadoe and Grace Brown, wife of Gus Brown. Respondent demurred to the complaint on the ground that it did not state facts sufficient to constitute a cause of action against him.
