On September 24, 1985, plaintiff, First National Bank of Decatur, brought suit in the circuit court of Macon County against defendant, Mutual'Trust Life Insurance Company, seeking to recover as assignee of a policy of life insurance issued by defendant on the life of Angelo Drakos, who was then deceased. After a subsequent amendment, defendant moved to dismiss the amended complaint, and, after a hearing, the court dismissed the complaint in bar of action on January 16, 1986.
